FARMINGTON — A convicted sex offender pleaded not guilty on Wednesday to three sexual assault charges against a 12-year-old girl.

John Fisher, 41, is charged with two counts of criminal sexual penetration against a minor and one count of criminal sexual contact against a minor.

Two of the assaults happened in July 2011 and one of the assaults was in July 2013 at Fisher's home on Troy King Road, Farmington police Detective Robert Pimentel said in the affidavit for Fisher's arrest. The alleged victim was a relative.

The criminal complaint against Fisher was filed in magistrate court Feb. 21, and he waived his preliminary hearing on Wednesday.

The police investigation into Fisher started in July when an anonymous source called the New Mexico Children, Youth and Families Department and said Fisher was assaulting a different relative, who was 9 years old.

All of the relatives who were interviewed as part of the investigation denied Fisher assaulted them, according to court documents.

Fisher, in an interview with police in July, allegedly confessed to three instances where he assaulted the 12-year-old girl. He said all the instances were brief, and he stopped himself shortly after he touched the girl.

After one of the 2011 assaults, the alleged victim reported the assault to Fisher and his wife, who called police. But in an interview, the victim said she was assaulted by a different man.

"I asked John why he didn't say anything that morning, when I tried to speak with him," Pimentel wrote of the 2011 sexual assault investigation. "He said he was upset about what happened and was trying to blame someone else."

The police investigation into that report never lead to the arrest, according to court documents.

Chief Deputy District Attorney Brent Capshaw said Fisher is a registered sex offender because of a conviction in Colorado.
